EU Investigates X for Algorithm Compliance with Digital Services Act

The European Commission is investigating X, requesting internal documents regarding its algorithms by February 15, focusing on compliance with the Digital Services Act (DSA). The European Commission is intensifying its investigation into X, the social media platform owned by Elon Musk. It has requested internal documentation pertaining to X’s algorithms, specifically the recommender system, by February 15. This investigation focuses on whether X is compliant with EU regulations concerning content moderation under the Digital Services Act (DSA).

Since December 2023, X has faced scrutiny over its management of illegal content and allegations of facilitating greater visibility for far-right opinions. This follows a series of Musk’s controversial interventions in European politics, including his support for Germany’s far-right AfD party.

Henna Virkkunen, the EU digital commissioner, emphasized the EU’s commitment to examining X’s compliance with DSA obligations. Virkkunen confirmed that the investigation would proceed unaffected by external political dynamics, reinforcing that any breaches could result in penalties for X.

In addition to the documents related to the recommender system, the investigation includes a retention order mandating X to preserve records of internal modifications to its algorithms from January 17 to December 31. Furthermore, the EU is requesting access to X’s APIs, which facilitate the automatic integration of third-party content.

Tech litigator Johnny Ryan noted the significance of the retention order, adding that it reflects the EU’s determination to uphold its legal frameworks. Some European politicians have raised concerns about Musk’s influence on elections, specifically referencing his interactions with far-right leaders. The EU is assessing if X’s algorithms promote specific narratives while suppressing alternative viewpoints.

In response to the criticisms directed at him, Musk argues that such claims undermine the principles of democracy and free speech.
