CAS Upholds Rubiales’ Three-Year Ban for Non-Consensual Kiss

Luis Rubiales’ appeal against his three-year football ban has been denied by the Court of Arbitration for Sport. His suspension stems from a non-consensual kiss with player Jenni Hermoso during the Women’s World Cup in 2023. A Madrid court found him guilty of sexual assault but acquitted him of coercion. Rubiales plans to appeal the ruling, with Hermoso also pursuing her own appeal.

The Court of Arbitration for Sport (CAS) has upheld the three-year ban imposed on Luis Rubiales, the former president of the Spanish football federation, following his non-consensual kiss with player Jenni Hermoso. This ban prevents him from participating in any football-related activities until October 2026.

The ban is a result of Rubiales’ actions during the Women’s World Cup medal ceremony in Sydney in 2023, where he kissed Hermoso without her consent. A Madrid court recently found Rubiales guilty of sexual assault and fined him 10,800 euros (approximately $11,300), but he was acquitted of coercion related to the incident.

CAS stated that Rubiales’ behavior amounted to serious violations of the FIFA Disciplinary Code, thus justifying the ban. Rubiales has indicated plans to further appeal the judgment, while Hermoso also intends to contest the court’s decisions regarding the case.
